Interpreting Section 301 in Good Faith and International Trade Dispute Resolution

On August 14th, 2017, President of the United States signed a memorandum, requesting the Office of the United States Trade Representative (“USTR”) to initiate a Section 301 investigation against China according to the U.S. Trade Act of 1974 Section 302(b). This investigation aims to make sure whether any Chinese laws, policies or practices are unreasonable or discriminatory that lead to damages to U.S. Intellectual Property, innovation or technology development. The USTR published a notice and announced this investigation on August18th. On October10th, public hearing regarding the initiation of the Section 301 investigation will be held in the United States International Trade Commission building. As at the close of business on September 28th, 45 associations, chambers of commerce, corporations or individuals submitted comments, and 10 of them requested to attend the public hearing and to testify before the USTR.
 
To offer an opportunity for the interested public to understand and learn more about the Section 301 investigation, DHH Washington DC Law Office will hold a lecture “Interpreting 301 in Good Faith and International Trade Dispute Resolution” on October 9th, 2017, 4:00pm - 6:00pm at 1300 Pennsylvania Avenue, NW, 7th Floor, Washington, D.C. About the Speakers:


 
JIANG Qi is the General Director of the Beijing DHH Law Firm. Mr. Jiang has practiced law for more than 20 years and handled more than 2,000 cases of which about 1,000 were litigation cases and about 1,000 cases were non-litigation cases, handling a cumulative case worth of over 100 billion RMB. Jiang Qi has long been committed to the study of legal issues of the letters of credit, independent guarantees, and trade finance. His doctoral thesis is “Study on Legal Risk of the Letter of Credit and International Trade Finance”. Jiang Qi focuses on providing legal services in the area of documentary credit, domestic letters of credit, independent guarantees and trade finance.
 

 

LIU Xinze is a Senior Partner of Beijing DHH Law Firm and the Executive Director of DHH Washington DC Law Office. Mr. Liu is mainly engaged in legal services such as appeals and responses to anti-dumping and anti-countervailing investigations for domestic industry. He is familiar with the domestic industry and market, and is an expert in accounting issues related to antitrust and anti-dumping. He also has a broad business experience and specializes in antitrust and overseas investment and M&A.
 

 
TANG Yongchang is the Business Director of DHH Washington DC Law Office. Mr. Tang focuses his practice on assisting foreign clients in China with corporate planning, corporate set up, mergers and acquisitions, intellectual property protection, general corporate law, and governmental lobbying. In the United States, Mr. Tang assists clients with general corporate law, mergers and acquisitions, real estate law, intellectual property protection, and securities law. 
 

 
FANG Chunhui is a Senior Partner and Patent Attorney of Beijing DHH Law Firm, candidate of UC Berkeley LL.M. professional track. Mr. Fang has in-depth knowledge of intellectual property laws in China, Europe and the United States and maintains close interaction with law practitioners overseas. 
 

 
REN Li is the Director of Cross-border Antitrust Team of our Beijing DHH Law Firm. Mr. Ren graduated from the Law School of University of International Business and Economics, where he obtained his Ph.D in law. He also earned an LL.M. degree from the Temple University Law School. As a senior lawyer specializing in antitrust law, Mr. Ren has more than 10 years of experience in antitrust notification, antitrust investigation in cartel and abuse, pre-merger counseling, etc. He has represented many companies in pre-merger filing process before MOFCOM in about 20 transactions, among which 3 cases were approved with condition. Mr. Ren has also advised and represented the target companies before SAIC or NDRC. With respect to dispute resolution, Mr. Ren has represented clients in numerous disputes relevant to share transfer agreements, real estate sales, international sale of goods, distribution agreement, surety under commercial transactions, etc.
