The Fourth Round of DHH’s Road-Shows in America: Boston—3+1 Blueprint on IP Protection for Foreign Enterprises in China & Seminar on Opportunities, Challenges and Paths for Overseas Chinese Entrepreneurs in China
With the progress of Sino-US trade negotiation, Beijing DHH Law Firm upheld the concept of serving clients all around the world and formed a road-show group of senior IP lawyers including Mr. Hao Chen, Ms. Yuexi Yao, Mr. Yimin Liu, Mr. Liang Mei and Mr. Yanhui Yang to deliver lectures on 3+1 Blueprint on IP Protection for American Enterprises in China across the United States. Of the 3+1 Blueprint, “3” means administrative, civil and criminal methods for IP protection, and “1” means the DHH’s service platform covering the whole China.
On the afternoon of March 20th, 2019, Beijing DHH Law Firm was invited to hold a Seminar on 3+1: Intellectual Property Protection for Foreign Enterprises in China in the conference room of KEEGAN WERLIN LLP. In the evening, the Seminar on Opportunities, Challenges and Paths for Overseas Chinese Entrepreneurs in China was held by Beijing DHH Law Firm at the Massachu-setts Institute of Technology (MIT) Tang Center in Boston to help overseas Chinese understanding the investment status in China better and to safeguard their rights and interests.
The keynote speakers of the two seminars were senior lawyers of DHH—Lawyer Hao Chen (“China Top15 IP Lawyers” by ALB ), Lawyer Yuexi Yao (with extensive experience in cross-border investment and financing, IP, artificial intelligence and data compliance services ), and Lawyer Yimin Liu (Well-known experts in emerging legal services such as data information, privacy, and virtual currency). The seminars attracted many American companies and many Chinese staying in America from Boston and its surrounding areas.
Ms. Yuexi Yao shared the China’s Opportunity--The Opportunities, Challenges and Paths for Overseas Chinese to Invest in China. She shared her own practical experience of Red-Chip/VIE architecture construction and overseas fund financing. Ms. Yao deeply analyzed the opportunities and dilemmas of overseas Chinese investment in China from various angles, as well as the countermeasures of American enterprises in China for intellectual property protection under the new situation.
Subsequently, Mr. Hao Chen and Mr. Yimin Liu conducted a sharing of “Intellectual Property from the Perspective of Start-up Enterprises”. Mr. Chen analyzed the main dilemmas encountered by US companies in the process of safeguarding their IP rights in China, such as trademark’s malicious registering, pirated software using, and so on. In allusion to these problems, Mr. Hao Chen shared related legal practical experiences in China, including creating a Blacklist to prevent malicious registration, raising statutory damages for copyright, shifting the burden of proof, improving the quality of patent creation, application, review, utilization and so on.
Subsequently, Mr. Yimin Liu delivered a speech on Criminal Protection of IP in the Era of AI. From the perspective of criminal protection of IP, lawyer Liu demonstrated the process of IP investigating criminal liability and the relationship among criminal, civil and preservation measures in combination with specific cases.
After their sharing, the participants said they got a clearer understanding of the opportunities for American enterprises to invest in China and the ways for scientific and innovative enterprises to develop in China, and then they also expressed their strong willing to cooperate with DHH in the future. After the forum a number of local lawyers, experts and representatives of American enterprises had a more in-depth exchange on the theme of this conference with the three keynote speakers.
This Seminar is the fourth round of DHH’s Road-Shows in America on the IP protection for American enterprises in China under the background of Sino-US Trade War.
