DHH Gave Advices on the Draft of Foreign Investment Law
The Ministry of Commerce of the People’s Republic of China announced the draft of Foreign Investment Law on January 19, 2015. The legislative authority is seeking opinions and advices in regard of the draft.
Currently, there exists a wide array of laws, regulations and codes on issues concerning foreign investment in China. This new Foreign Investment Law is more than a mere revision or consolidation of The Law of the PRC on Foreign-Capital Enterprises, The Law of the PRC on Chinese-Foreign Equity Joint Ventures and The Law of the PRC on Chinese-Foreign Contractual Joint Ventures (commonly referred as “three-capital” law), but a complete reform on the whole system of foreign investment in China.
This newly-introduced draft should be interpreted as a beginning of a profound economic reform that will affect the future of foreign investment in China and even the economic development in China as a whole.
