"The Exploration of Chinese lawyer's Foreign Legal Services" by Liu Kejiang Published on Chinese Lawyer

Recently, the article “The exploration of Chinese lawyer’s foreign legal services” written by Mr. Liu Kejiang, executive director of Beijing DHH Law Firm was published on Chinese Lawyer. Since the principle of “rule of law” is one major topic of discussion during the Fourth Plenary Session of 18th CPC Central Committee, the article explored the question of “going abroad” for Chinese lawyers.
 
Mr. Liu analyzes the current situation of foreign legal services in China. He believes that there is now a shortage on the supply of lawyers specializing in the areas of anti-trust, anti-dumping, anti-subsidy, intellectual property, international maritime law and international investment in China. The reason behind this problem, Mr. Liu holds, is that there has not been sufficient support from Chinese government. Both the managers in charge of state-holding enterprises and those at the private sector often neglect the importance of Chinese lawyers who specializes in foreign affairs. Moreover, a large number of lawyers specializing in foreign services are ill-equipped.
 
Mr. Liu demonstrates that there are three main ways to improve the practicing environment of foreign legal services in China. First, Chinese law firms should establish oversea offices especially in areas where international business are active; second, Chinese law firms should attempt to recruit Chinese lawyers with oversea practicing and education background; finally, Chinese law firms should also try to hire foreign lawyers.
 
Mr. Liu believes that the “talent strategy” is one crucial aspect of improving China’s foreign legal services and Chinese law firms should maintain an open mind in attracting qualified Chinese students with oversea legal education as well as foreign-registered lawyers. Only by promoting this strategy, China’s foreign legal services may achieve the goal of being “network internationalized and service localized.”
