Recently, a disputed trademark case between U.S. Noble Fiber Tech Co., Ltd and a company based in Shanghai was revoked by the State Administration for Industry & Commerce. Mr. Chen Hao of the intellectual property team in DHH Beijing office represented U.S. Noble Fiber Tech Co., Ltd and successfully helped the client revoke all disputed trademarks.

"X-STATIC" is an original trademark created by U.S. Noble Fiber Tech Co., Ltd. Having been registered in many countries and regions around the world, the trademark is well-known and widely-used globally. However, "X-STATIC" has been registered first by a Shanghai-based company which has prior business relationship with Noble in mainland of China. Before coming to DHH Law Firm, Noble Fiber attempted and failed to resolve the issue by appealing to various means.

By communicating numerously with the client and collecting a great deal of evidences, the team led by Mr. Chen Hao came up with a detailed plan, in which the team clarified the term "agent" under trademark law and was eventually able to prove that the action of registering the trademark of Noble by the Shanghai-based company was an unfair behavior under bad faith. Finally, the State Administration for Industry & Commerce decided that the appealing of revocation from our side is reasonable and that the trademarks registered by the Shanghai-based company were invalid.
