DHH lawyers team received full support for arbitration requests in Hong Kong arbitration cases

Lawyers of Beijing DHH recently represented a large state-owned automobile manufacturing company in an arbitration case involving a dispute over an international sale of goods contract between New Zealand dealers.

DHH lawyers won the case, and the arbitration request was fully supported. This case was arbitrated at the China International Economic and Trade Arbitration Commission (Hong Kong Arbitration Center), where Hong Kong law was applicable.

The parties in this case were located in the Mainland, Hong Kong and New Zealand. The main difficulties were: 1. This case was a relatively typical transaction of international goods. Due to the participation of the agent, the contract performance entity was inconsistent with the contracting entity, which made it difficult for the actual performance party of the transaction to be bound by the arbitration clause; 2. The transaction happened a while ago, thus some of the evidence could not be retained, and the actual participants resigned, resulting in the lack of part of the evidence chain. At the same time, for reasons such as the written evidence of many transaction facts was not left, it was difficult to restore the transaction facts of this case. Through a lot of rigorous and meticulous work of the team, the clues of the transaction were finally clarified and the transaction process was restored, laying a solid foundation for the final victory ruling.
