Online Seminar on “Legal Issues Concerning Difficulties in Import and Export Contract Performance under the Global Epidemics”
The seminar invited experts in the fields of international trade and international commercial arbitration. Ms. Shuli YE, partner of Beijing DHH Law Firm, as the moderator, started discussion by addressed such issues as foreign trade enterprises' responded to contracts and laws during the epidemic period, and mediation and arbitration in international trade and settlement of contract disputes. Ms. Ye provided risk prevention and the dispute solution mentality and the practical suggestion for the attendees.
Mr. Hao WEN, Secretary General of the Chamber of Commerce for Import and Export of Shenzhen City, delivered the keynote speech on the Review of the Import and Export Trade under the Background of the Epidemic Situation. Dr. Qi JIANG, managing partner of Beijing DHH Law Firm, shared Analysis of Difficult Cases of Performance in the Context of Global Epidemic. Jiang introduced the ten legal risks involved in international trade at first. Regarded to the "Force Majeure and Hardship" and the “Current Corona Virus Epidemic,” and through the ingenious combination of theory and case; Jiang vividly analyzed the different practices of force majeure and hardship under civil law system, common law system, international conventions and Chinese law. And shared his practical experience and suggestions.
Dr. Yifei LIN, arbitrator and partner of Shenzhen International Arbitration Institute, shared the Contractual and Legal Responses of Foreign Trade Enterprises during the Epidemic Period: Risk Prevention and Dispute Resolution. He began his speech from the background of the obstacles caused by the epidemic to the performance of contracts by foreign trade enterprises. He introduced the applicable laws for force majeure and change of circumstances and matters for attention in defense were introduced. He specifically on the current process of export of epidemic prevention materials may exist in the process of foreign trade enterprises and made suggestions.
Mr. Guoyong HUANG, director of the International Cooperation and Development Division (FTA Arbitration Division) of Shenzhen Court of International Arbitration, shared the Guidelines on international trade mediation and arbitration and contractual disputes settlement. Director Huang introduced the outstanding advantages of international commercial arbitration in the field of resolving international trade disputes by contrasting and analyzing multiple ways of resolving international trade contract disputes and combining with the actual cases and executive data of Shenzhen International Arbitration Institute. Director Huang also introduced the diversified dispute resolution mechanism of Shenzhen International Arbitration Institute. He focused on the effective experience and practical results of the "mediation + arbitration" model in China.
