Tianjin Maritime Mediation Center sends Mediation Advice Letter to ConocoPhillips China and CNOOC
On June 9th the Tianjin Maritime Mediation Center of China Maritime Arbitration Commission sent a “Mediation Advice Letter” to ConocoPhillips China and China National Offshore Oil Corporation (CNOOC). With the Letter were sent the “Civil Mediation Application” by the 43 fishermen from Tijian and Shandong, the relevant agreement on maritime mediation, the mediation rules and the mediation guide etc.
According to the lawyers representing the complainants, Li Gang and Zhang Xingkuan, the claim amount was calculated according to the criterion by which the fishermen in Liaoning and Hebei Province had been compensated. Liu Kejiang, Head of the International Commercial Practice of DHH expressed his hope that ConocoPhillips China and CNOOC would not decline the mediation. By doing so, he said, they would miss a good opportunity to solve the disputes via a mechanism widely adopted internationally and which was the rational choice for a multinational corporation to maintain its corporate citizen image.
