Public Announcement of Filing Information of Overseas Branches of Beijing Law Firms

In order to promote the development of foreign-related legal services, and safeguard the operations of law firms’ overseas branches, use of foreign exchange and residents’ legitimate rights and interests, in accordance with the “Notice on the Issue of the ‘Administrative Provisions on Filing of Overseas Branches of Law Firms’ by the Ministry of Justice” (Si Gui [2019] No. 1), the Beijing Municipal Bureau of Justice Administrative Approval Office issued a notice of the filing of overseas branches to the legal profession in September, requiring law firms to submit the relevant materials that comply with the conditions in the Ministry's Notice.
By now, 23 law firms have submitted filing materials of 71 overseas branches, all of which have been reviewed. 64 qualified overseas branches have been filed for the record and reported to the Ministry of Justice.
Next, all the law firms shall pay attention to the following points:
1. After filing, Beijing Municipal Bureau of Justice Administrative Approval Office will communicate with the Ministry of Justice on the implementation of policies on foreign exchange management and other aspects in a timely manner and will provide a notification. All the law firms that have filed materials for the record shall pay attention to it;
2. The law firms that have submitted materials but have not been filed this time due to insufficient materials may continue to supplement the proof materials;
3. The filing of overseas branches of law firms is a long-term regular work. In order to receive the future support of favorable policies, the law firms that have not applied for the filing can submit relevant materials to Beijing Municipal Bureau of Justice Administrative Approval Office at any time.
