On September 27, 2018, Beijing DHH Law Firm Seattle Office Opening Ceremony was held at the Safeco Plaza Building on 4th Avenue in downtown Seattle, which witnessed the establishment of the 47th office of DHH as well as the 9th physical office overseas.  Mr. Yanhui Yang, Director of Beijing DHH Law Firm Seattle Office, presided over the opening ceremony. Mr. Qi Jiang (Managing Partner of DHH and Director of Beijing DHH Law Firm), Mr. Yuhui Xu, Mr. Litang Fang, Mr. Qingjun Meng (Senior Partners of DHH), Partner Jinlun Guan, Mr. Liang Mei (Managing Director of Beijing DHH Law Firm Washington D.C. Office), and dozens of honored guests from the legal, business, cultural and Oversea-Chinese communities in Seattle attended the Opening Ceremony.

At the same time, Recognition & Enforcement of China-US Judgments and Parallel Litigation Legal Issues Seminar was held jointly by Beijing DHH Law Firm Seattle Office and Beijing DHH Law Firm Washington D.C. Office. The seminar was conducted on issues of a large number of domestic debtors fleeing to the United States and domestic creditors having no effective remedy; and the following topics were discussed: how to implement Chinese court judgments in the United States; how to implement the US court judgments in China; legal system of “Piercing the Corporate Veil” in China and the United States; parallel lawsuits in China and the United States for pursuing transnational debt.

Mr. Qi Jiang and Mr. Liang Mei gave a keynote speech on above topics. Attendees from the Seattle Legal Profession have conducted in-depth and extensive discussions on these issues, including Ms. Yuping Wang(Senior Partner and Head of China operations of Davis Wright Tremaine LLP), Mr. Andy Tolesand Mr. Greg Easu(Partners of Ellis, Li & McKinstry PLLC), Lawyer Cosmin Popa(Originator of Law Office of Cosmin Popa), Lawyer Angus Ni(Senior Consultant of Hung G. Ta. Esq. PLLC), Lawyer Xiaohe Cao(Originator of Lani Cao Law Office), Lawyer Zhizhou Wang(Researcher of Asian Law Center in University of Washington Law School). Founder of Lani Cao Law Office, Cao Yuhe and Washington University Law School Asian Law Center Researcher, Wang Zhizhou, have conducted in-depth and extensive speeches on these issues.
 

Mr. Qi Jiang talked about how to recognize and enforce the Chinese judgment in the United States; how to recognize and enforce the US judgment in China; how to pierce the corporate veil in China and the United States, and the jurisdictional issues in the China-US parallel litigation.

 
 

Mr. Liang Mei analyzed the US court's recognition and enforcement of foreign judgments, the US legal principles of the puncture of corporate veil, sharing his understanding about Article 20 of the Chinese Company Law.


Ms. Yuping Wang (Senior Partner of Davis Wright Tremaine LLP) evaluated the main ways for malicious debtor to take trust and hide property offshore in the United States.


Mr. Angus Ni (Senior Consultant of Hung G. Ta. Esq. PLLC in Commercial Litigation) commented on the methods, strategies and third-party funding issues in the US lawsuit.


Mr. Zhizhou Wang (Researcher of Asian Law Center in University of Washington Law School) analyzed the impact of the bankruptcy law on cross-border recovery, and suggested that establishing a trust in the United States with property, acquired by fraudulent means such as fraudulent means, may be punctured the company veil.


Ms. Xiaohe Cao (Founder of Lani Cao Law Office) analyzes issues on path and legitimacy of cross-border transfer of property from the perspective of American immigration lawyers.


Mr. Cosmin Popa (Founder of Law Office of Cosmin Popa) commented on legal issues such as the establishment and withdrawal of US trusts.


The guests were absorbed in the keynote speeches given by Qi Jiang and Liang Mei.

At the end of Seminar, Beijing DHH Law Firm and Beijing DHH Law Firm Washington DC Office jointly proposed the Seattle Initiative, calling on Chinese and American lawyers to combine transnational legal resources against malicious escape of debt and transfer of property to overseas jointly:  to apply for the US court to execute Chinese judgments; to file parallel lawsuit both in China and the United States; to trace the malicious debtor’s US property clues, to pierce the veil of a company established to hide property, and to abolish the debt plan set up by the debtor for collecting waste debts. Chinese and American lawyers are supposed to unite as one to protect the legitimate interests of creditors and to safeguard the fairness and justice of the law.
