On August 14th, 2017, President of the United States signed a memorandum, requesting the Office of the United States Trade Representative (“USTR”) to initiate a Section 301 investigation against China according to the U.S. Trade Act of 1974 Section 302(b). This investigation aims to make sure whether any Chinese laws, policies or practices are unreasonable or discriminatory that lead to damages to U.S. Intellectual Property, innovation or technology development. The USTR published a notice and announced this investigation on August18th. On October10th, public hearing regarding the initiation of the Section 301 investigation will be held in the United States International Trade Commission building. As at the close of business on September 28th, 45 associations, chambers of commerce, corporations or individuals submitted comments, and 10 of them requested to attend the public hearing and to testify before the USTR.
